Terms of Service

These terms cover three things. Using this website, using the apps I publish, and buying a license for one of them. They are between you and me, Douglas Lassance, and using the site or an app means you accept them. If you bought through the Mac App Store, Apple's terms govern the purchase itself and these terms cover the app around it.

Using this website

The site is here to read, and there is nothing to sign up for. Do not attempt to break into it, hammer it, or use the contact form to send anything you would not want attributed to you. The text, artwork, screenshots, and app names on it are mine unless credited otherwise, so quote and link freely but do not republish them wholesale or present them as your own.

The apps

Each app is licensed to you, not sold. The license is personal, non-exclusive, and covers installing and using the app on the Macs you own or control, for as long as it is valid. You may not resell it, rent it out, share the key, redistribute the app, or work around the license check. Reverse engineering is permitted only where the law says it cannot be forbidden.

Some apps are free and some are paid. A free app, a beta, or a preview build carries no promise of support or of ever shipping, and I may stop publishing any app at any time. An app you have already installed keeps working; I am not obliged to keep it updated for a future version of macOS.

Buying a license

Apps sold directly are paid for through Stripe, at the price shown at checkout, in the currency shown. The key is emailed to you when the payment clears. It is yours to keep, and losing it is fixable, so get in touch rather than buying a second one. A key that turns up shared publicly, or a purchase that is refunded or charged back, is revoked.

A license key is digital content delivered immediately. If you are a consumer in the EU or the UK, you have a statutory right to withdraw from a distance purchase within fourteen days, and that right ends once delivery begins with your consent. By completing the purchase you ask for the key to be sent right away and accept that the withdrawal right is spent once it is. That is the law's position, not mine, and it does not stop you from asking. If an app is not what you expected, say so within fourteen days and I will refund it.

Nothing here limits the rights you have under consumer law where you live, including the remedies you are owed if an app is faulty or not as described.

What I do not promise

The apps and this website are provided as they are. Beyond the consumer rights above and anything else the law will not let me disclaim, I make no warranty that an app is free of defects, fit for a particular purpose, or able to do a specific job for you. Keep backups of anything you value. An app that reads your files can still be the thing that was running when something went wrong.

To the extent the law allows, I am not liable for indirect or consequential loss, lost data, or lost profit, and my total liability for any claim is limited to what you paid for the app it concerns in the twelve months before the claim. This does not exclude liability for death, personal injury, or fraud, which cannot be excluded.

Ending it

You can stop using an app whenever you like, and uninstalling it is the whole procedure. I may revoke a license if these terms are broken, in which case the license ends and the app stops unlocking. The sections on liability and governing law outlive the license.

Governing law

These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules, and disputes belong to the courts of Los Angeles County. If you are a consumer elsewhere, this does not take away the right to bring a claim in your own country's courts where the law gives you that right.

Changes to these terms

If these terms are updated, the revised version is posted on this page with a new "Last updated" date. A change applies to what you do after it is posted, not to a purchase you already made.
